1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Lotus Moon (“Lotus Moon,” “we,” “us,” or “our”), governing your access to and use of the Lotus Moon application, website located at lotusmoon.fit, mobile application, and all related services, features, content, and functionality (collectively, the “Service”).

By creating an account, accessing, or using the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

The Service is intended for users who are at least 18 years of age or the age of majority in their jurisdiction, whichever is higher. By using the Service, you represent and warrant that you meet all eligibility requirements.

3. Description of Service

Lotus Moon is a yoga, meditation, and tarot platform that provides yoga classes themed to the Major Arcana tarot cards, guided meditations, self-paced workshops, AI-powered tarot readings, daily wellness tracking, community features, and live event registration.

3.1 AI-Generated Content

You acknowledge that tarot card interpretations and certain recommendations provided by our Service are generated by artificial intelligence and are intended for entertainment, self-reflection, and personal growth purposes only. While we strive to provide meaningful and helpful content, AI-generated interpretations may vary and should not be relied upon as professional advice of any kind.

3.2 Third-Party Integrations

Our Service integrates with third-party services for payment processing, mobile subscriptions, and other functionality. Your use of such third-party services is subject to their respective terms of service and privacy policies. Lotus Moon is not responsible for the acts or omissions of any third-party service providers.

4. Account Registration and Security

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You may not create more than one account per person or share your account credentials with any third party.
• You are responsible for all activities that occur under your account.

5. Subscriptions and Payment Terms

5.1 Subscription Plans

• Free Tier: Access to select free content at no cost.
• Monthly Subscription: $14.99 per month for unlimited access to all premium content and features.
• Annual Subscription: $129.00 per year for unlimited access to all premium content and features.

5.2 Event Payments

Certain live events (such as Swiftie Yoga classes) require separate one-time payment. Event pricing is displayed at the time of registration.

5.3 Billing and Payment

All payments are processed through our third-party payment processor, Stripe (web), or through in-app purchase via the App Store or Google Play (mobile). By subscribing to a paid plan, you authorize us to charge the payment method you provide for the applicable subscription fees.

5.4 Price Changes

We reserve the right to change subscription prices at any time. Any price changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle.

6. Cancellation and Refund Policy

You may cancel your subscription at any time through your account settings, the Stripe billing portal, or by contacting customer support. Upon cancellation, you will retain access to premium features until the end of your current billing period. No refunds will be provided for partial billing periods.

Refund requests are evaluated on a case-by-case basis and must be submitted within 14 days of the charge.

7. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Upload, transmit, or distribute any unlawful, harmful, or objectionable content.
• Harass, bully, or intimidate other users in community spaces.
• Impersonate any person or entity.
• Interfere with or disrupt the Service.
• Attempt to gain unauthorized access to any portion of the Service.
• Use any automated means to access or collect data from the Service.
• Reverse engineer, decompile, or disassemble the Service.

8. Community Guidelines

Our community features (moon circles, discussions, challenges) are spaces for supportive and respectful interaction. By participating, you agree to:

• Treat all members with respect and kindness.
• Keep discussions relevant to wellness, yoga, meditation, and personal growth.
• Not share medical advice or present yourself as a medical professional unless appropriately licensed.
• Respect the privacy of other community members.

We reserve the right to remove content and suspend accounts that violate these guidelines.

9. Intellectual Property Rights

The Service and its entire contents, including but not limited to yoga class content, meditation recordings, tarot card descriptions, workshop materials, and software, are owned by Lotus Moon, its licensors, or other providers and are protected by intellectual property laws.

You retain ownership of any content you create or submit through the Service (“User Content”), including journal entries, discussion posts, and moon circle reflections. By submitting User Content to community features, you grant Lotus Moon a worldwide, non-exclusive, royalty-free license to display such content in connection with operating the community features of the Service. Private content (journal entries, tarot readings) is never shared or displayed publicly.

10. Disclaimers

10.1 No Medical or Professional Advice

THE SERVICE IS NOT INTENDED TO PROVIDE MEDICAL, PSYCHOLOGICAL, OR PROFESSIONAL HEALTH ADVICE.

Yoga classes, meditations, and wellness features are provided for general wellness and personal enrichment purposes only. You should consult with a qualified healthcare professional before beginning any exercise program or making significant changes to your wellness routine. If you experience pain or discomfort during any yoga practice, stop immediately and consult a healthcare provider.

10.2 Tarot and Spiritual Content

Tarot readings, zodiac-based content, and other spiritual features are provided for entertainment, self-reflection, and personal growth purposes only. They should not be used as a substitute for professional advice of any kind.

10.3 Cycle Tracking

The cycle tracking feature is provided for personal awareness and wellness planning purposes only. It is not a medical device and should not be relied upon for medical or contraceptive purposes.

10.4 “As Is” and “As Available”

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOTUS MOON BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO LOTUS MOON IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Lotus Moon from and against any and all claims, liabilities, damages, losses, costs, and expenses arising out of or in connection with your use of the Service or violation of these Terms.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at legal@lotusmoon.fit to attempt to resolve any dispute informally.

13.2 Binding Arbitration

IF WE CANNOT RESOLVE A DISPUTE INFORMALLY, YOU AND LOTUS MOON AGREE THAT ANY DISPUTE WILL BE RESOLVED BY BINDING ARBITRATION, RATHER THAN IN COURT, except that either party may bring an individual action in small claims court if the claim qualifies.

13.3 Class Action Waiver

YOU AND LOTUS MOON AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

13.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@lotusmoon.fit within 30 days of first accepting these Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas. For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.

15. Termination

You may terminate your account at any time. We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, effective immediately.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the modified Terms.
